About the Class Action

Walmart’s Spark delivery app is facing allegations of violating Illinois' Biometric Information Privacy Act (BIPA). The app reportedly requires drivers to undergo mandatory facial recognition scans, potentially without proper consent or disclosure.

 

BIPA is a crucial law protecting individuals’ biometric data—such as facial scans and fingerprints—by requiring companies to obtain informed consent before collecting or storing this sensitive information. The law also grants individuals the right to take legal action if their data is misused or mishandled. With a five-year statute of limitations, those affected by Spark's biometric practices in the past five years may be eligible to join Simon Law Co.’s class action investigation.
